1. Agreement to these terms

These Terms of Service ("Terms") govern your use of florimetry.shop (the "Site") and any purchase from Florimetry ("we," "us," "our"), located at 6 Berry Patch Rd, Amelia, OH 45102. By using the Site or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy and Refund Policy, which are part of these Terms. If you don't agree, please don't use the Site.

2. Eligibility and service area

You must be at least 18 years old, or the age of majority where you live, to place an order. We sell and ship only to addresses within the United States. We may refuse or cancel orders placed with a non-US shipping address.

3. Products and descriptions

All products sold on the Site are artificial (faux) botanicals made from fabric and other synthetic materials. We work to describe and photograph products accurately, including listed heights and components. However, colors can appear differently on different screens, dimensions are approximate and may vary slightly, and arrangements are compressed for shipping and may need reshaping. Vases and props shown in photos are not included unless the listing says so.

4. Pricing and availability

All prices are in US dollars. Prices, promotions and availability can change at any time without notice. "Compare at" prices reflect the item's previous or regular selling price. We reserve the right to correct pricing or description errors, and to cancel orders affected by such errors, even after an order is confirmed. If we cancel an order you've paid for, we'll refund you in full.

5. Orders and acceptance

Your order is an offer to buy. We accept it when we ship the products to you. Before then, we may decline or cancel any order, limit quantities, or cancel orders we suspect are fraudulent, placed by resellers, or in violation of these Terms. An order confirmation email confirms that we received your order; it is not acceptance.

6. Payment and taxes

We accept the payment methods shown at checkout. By submitting payment, you confirm you're authorized to use that payment method and authorize us and our payment processor to charge the total shown, including shipping and applicable sales taxes. You are responsible for any taxes that apply to your purchase.

7. Shipping, title and risk of loss

Products are shipped as described in our Shipping Policy. Title and risk of loss pass to you when the products are delivered to the shipping address you provided.

8. Returns and refunds

Returns and refunds are handled under our Refund Policy.

9. Use of the Site

You agree not to: use the Site for any unlawful purpose; attempt to gain unauthorized access to the Site or its systems; interfere with the Site's operation, including through bots, scrapers or malicious code; submit false information or place fraudulent orders; or copy, reproduce or resell Site content without our written permission.

10. Intellectual property

The Site and its content, including text, graphics, logos, product descriptions and page design, are owned by or licensed to Florimetry and protected by US intellectual property laws. You may view and print pages for personal, non-commercial use only.

11. Reviews and submissions

If you send us comments, photos, reviews or suggestions, you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce and display them in connection with our business. You confirm that your submission is accurate, that you have the right to share it, and that it doesn't violate anyone else's rights.

12. Product safety

Products are for indoor decorative use only. They are not toys and may contain small parts and wires. Keep out of reach of young children and pets who may chew them, and keep away from open flames and heat sources.

13. Disclaimers

Except as expressly stated in these Terms and to the extent permitted by law, the Site and products are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms limits any warranty that cannot be excluded under applicable law.

14. Limitation of liability

To the fullest extent permitted by law, Florimetry will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or products. Our total liability for any claim relating to a product or order will not exceed the amount you paid for that order. Some states don't allow these limitations, so they may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Florimetry and its owners, employees and agents from claims, losses and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site.

16. Governing law and disputes

These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Before filing any claim, you agree to first contact us at support@florimetry.shop and try to resolve the dispute informally for at least 30 days. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Clermont County, Ohio, and you consent to their jurisdiction. Either party may bring an individual claim in small claims court where eligible.

17. Changes to these terms

We may update these Terms from time to time by posting a new version on this page. Changes apply to orders placed after the updated date. Your continued use of the Site means you accept the updated Terms.

18. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms, together with the policies referenced above, are the entire agreement between you and Florimetry regarding the Site and your purchases.
